Het volgende Belgisch-Nederlands rechtshistorisch congres zal doorgaan van 22 tot 23 maart 2007 in Groningen. Voorstellen voor lezingen kunnen gemaild worden aan J.H.A.Lokin@rug.nl tot en met 10 november 2006.
Met aandrang wordt gevraagd dat zoveel mogelijk jonge rechtshistorici van deze kans gebruik maken om hun onderzoek voor te stellen.
De bijdragen zullen worden gepubliceerd (bij gebleken geschiktheid) in de Groninger Opmerkingen en Mededelingen.

PhD and Post Doc positions at the University of Amsterdam for a research project on the evolution of lawmaking from an historical and economic perspective

Research will be carried out at the ACLE facilities in Amsterdam. Visiting a foreign institution during the duration of the project will be encouraged. The working language is English but proficiency in French / German / Spanish / Italian will be appreciated. The project will involve historical research and both theoretical and empirical economic research. Familiarity with all of these areas of research is not a prerequisite but willingness to work in an interdisciplinary fashion with the other members of the team is required.
Project title and description : Fiat Lex: The Evolution of Lawmaking
Why did some countries develop common law while others adopted a civil law system? Is judge-made law more adaptive to the needs of the economy than legislation? Such questions have appealed not only to lawyers, but also to philosophers from Aristotle to Bentham and Hart, sociologists such as Weber and economists, starting from Hayek. Three decades ago, proponents of the efficiency-of-the-common-law hypothesis postulated that judge-made law is more efficient than legislation because inefficient rules are litigated out of the system. More recent law and finance literature has emphasized that the common law fosters financial development. Legal origins literature has linked the origins of these different systems to the balance of political power between central and local authorities. According to these views, politics determines the lawmaking system, which in turn determines economic performance. However, arguments and evidence to the contrary have emerged and definitive answers are still lacking. The proposed research advances a novel approach to these problems by focusing on ancient Rome. Rome provides an ideal case study to draw lessons for the present, because it initially relied on legislation, then adopted judge-made law and finally reverted to legislation. Studying the rise and fall of judge-made law in Rome during roughly 10 centuries of unbroken legal development from the XII Tables to the Corpus Juris, this proposal aims at advancing our understanding of what determined the evolution from legislation to judge-made and backwards and what effects this had for the Roman legal system. The analysis focuses on accountability of the lawmaking institutions and adaptability of the legal system to the needs of the economy (enforcement of contract and protection of property).

Inmiddels bestaat de mogelijkheid, een open brief aan de ministerpresident en de regering van Baden-Württemberg te tekenen. Reacties uit het buitenland zijn natuurlijk erg welkom en kunnen de actie extra kracht bijzetten. Door te tekenen kunnen we met weinig moeite het gevoel van machteloosheid doorbreken en bijdragen tot een gunstige oplossing van dit conflict.
